And the widespread deterioration of the environment, especially during activities such as the establishment of chemical plants and the outbreak of conflict, is the first and weakest victim, nature and the environment. Therefore, in order to protect the environment, and in particular, the international environment, countries and international legal institutions, in order to better protect the environment, have set and developed rules to protect the environment. These are international treaties that have been drafted globally and regionally and have made binding commitments to them in this regard. Now we must continue to protect the environment both in times of conflict and in times of peace, and this study seeks to explain how and on what basis the environment can and should be protected and held accountable. The internationalization of governments is the result of a gross violation of environmental principles based on which international principles and rules, and its theoretical foundations are described. This responsibility is an obligation imposed on each member of the international community, and in the event of a breach of that obligation, the government will be liable for damages. The process of international responsibility resulting from gross environmental violations has undergone relatively positive changes over time and through many ups and downs. But these developments have been very slow and time consuming. In a way, it may not be far from the truth to say that the process of change in this area has been much slower than in other areas of international law. This study concludes that the international liability of states resulting from gross environmental violations in the present age is generally subject to the general rules of international liability in public international law. بحث «تعهدات دولت ها در رعایت اصول بنیادین حقوق بین الملل محیط زیست» که در این مقاله به روش توصیفی-تحلیلی از منابع کتابخانه ای و اسنادی، مجال سخن یافته است یکی از موضوعات مهم حقوق بین الملل را تشکیل می دهد چراکه امروزه یکی از جنبه های دهشتناک پیش رو، تخریب و زوال گسترده محیط زیست می باشد به خصوص در هنگام فعالیت هایی همچون تأسیس کارخانجات مواد شیمیایی و بروز مخاصمات و درگیری ها، اولین و ضعیف ترین قربانی، طبیعت و محیط زیست می باشد. لذا در راستای حمایت از محیط زیست و به طور خاص، محیط زیست بین المللی، کشورها و نهادهای حقوقی بین المللی، برای صیانت بهتر از محیط زیست، دست به تنظیم و تدوین قواعدی برای حمایت از محیط زیست زده اند. این ها معاهدات بین المللی هستند که در سطح جهانی و منطقه ای تدوین گشته اند و تعهداتی الزام آور در این خصوص پیش روی آن ها ترسیم کرده اند. حال در پی این باید بود که حمایت از محیط زیست را هم در زمان مخاصمات و هم در زمان صلح نیز استمرار بخشید و این پژوهش نیز در پی تبیین این مسئله می باشد که چگونه و بر چه اساس می توان و باید از محیط زیست حمایت کرد و مسئولیت بین¬المللی دولت ها ناشی از نقض فاحش اصول زیست محیطی مبتنی بر کدام اصول و قواعد بین¬المللی می¬باشد و مبانی نظری آن تشریح شده است. این مسئولیت، تعهدی است که بر هر یک از تابعان جامعه ی بین المللی بار شده که در صورت نقض آن تعهد، مسئولیت آن دولت را در جبران خسارات وارده در پی خواهد داشت. فرایند مسئولیت بین¬المللی ناشی از نقض فاحش زیست محیطی درگذر زمان و با طی فراز و نشیب¬های زیاد دچار تحولات نسبتاً مثبتی گردیده است. اما تحولات صورت گرفته آرام و تدریجی بوده است. به طوری¬که می¬توان گفت تغییرات در این حوزه بسیار کندتر از دیگر حوزه¬های حقوق بین¬الملل بوده است. این پژوهش نتیجه می گیرد که مسئولیت بین¬المللی دولت ها ناشی از نقض فاحش زیست محیطی در عصر حاضر به طور کلی تابع قواعد کلی مسئولیت بین¬المللی در حقوق بین الملل عمومی می¬باشد. /downloadfilepdf/108784
