Artificial intelligence algorithms are typically designed in a complex and non-interpretable manner, which may lead to violation of human rights or the use of such algorithms in the collection and processing of personal data, thereby violating privacy or legal rights of individuals. With the transparent and interpretable design of artificial intelligence algorithms which should be developed by organizations and governments and by using privacy protocols and laws in collecting and processing personal data and designing appropriate mechanisms to modify and protest decisions, it is possible to mitigate the challenges arising from the use of artificial intelligence. The main goal of this research is to gain a deeper understanding of the impacts of this innovative technology on the principles and fundamental concepts of human rights and fundamental freedoms. This article uses library tools and descriptive-analytical methods to better understand the challenges and opportunities that artificial intelligence creates for human rights and fundamental freedoms or threatens them. The present research focuses on providing solutions for determining appropriate legal standards to preserve fundamental rights and manage them in the digital world. با توجه به پیشرفت‌های روزافزون در حوزه هوش مصنوعی، پژوهش درباره اثر هوش مصنوعی بر آزادی‌های اساسی و حقوق بشر اهمیت بسیار زیادی دارد. معمولاً الگوریتم‌های هوش مصنوعی به‌صورت پیچیده و غیرقابل‌‌تفسیر طراحی می‌شوند که ممکن است منجر به نقض حقوق بشر شده یا استفاده از آن در جمع‌آوری و پردازش داده‌های شخصی به نقض حریم خصوصی یا حقوق قضایی افراد منجر شود. با طراحی شفاف و قابل تفسیر الگوریتم‌های هوش مصنوعی که باید توسط سازمان‌ها و دولت‌ها طراحی شود و همچنین با استفاده از پروتکل‌ها و قوانین محافظت از حریم خصوصی در جمع‌آوری و پردازش داده‌های شخصی و طراحی مکانیسم‌های مناسب برای اصلاح و اعتراض تصمیمات می‌توان از چالش‌های ناشی از اعمال هوش مصنوعی کاست. هدف اصلی این پژوهش، تضمین محافظت از حقوق بشر و آزادی‌های اساسی در دنیای دیجیتال و کمک به جامعه و سازمان‌ها جهت بهره‌‌مندی از پتانسیل هوش مصنوعی با هدف بهبود زندگی انسان‌ها است. در این مقاله با استفاده از ابزار کتابخانه‌ای و روش توصیفی-تحلیلی به شناخت بهتر چالش‌ها و فرصت‌هایی که هوش مصنوعی برای حقوق بشر و آزادی‌های اساسی ایجاد می‌کند یا باعث تهدید آن‌ها می‌شود و چگونگی تأثیر هوش مصنوعی بر حقوق بشر و آزادی‌های اساسی می‌پردازیم. پژوهش حاضر به ارائه راهکارهایی برای تعیین استانداردهای قانونی مناسب جهت حفظ حقوق اساسی و مدیریت آن در دنیای دیجیتال پرداخته است. /downloadfilepdf/1153703
