Everything that is said about the laws of war, humanitarian rights, and human rights, was buried in this war and a cemetery of international treaties was created. The obligations contained in the four Geneva Conventions, the Convention on the Protection of Children's Rights, the Universal Declaration of Human Rights, the rules prohibiting the use of force and many other international documents, which are mainly in the form of international custom for all Subjects are required to be subjects in international law, in October 2023 Israel's attacks on Gaza were ignored and the claimants were also watching these obvious violations. It seems that international law continues to suffer from the weakness of its basis, which is the void of proper executive guarantee. The owners of the veto right can never realize the global will and reduce countless human sufferings. Although in the legislative phase, rules have been formulated in accordance with human rights, but these regulations are not able to create implementation contexts without the existence of a binding authority. آنچه از افعال ارتکابی رژیم اسرائیل و حامیان آن در غزه برمی¬آید، این است که حقوق بین¬الملل با تمامی اوراق و اسناد خود و در سایه¬ی سازمان¬های پرسرو صدای خود، هیچ نقشی ایفا نکرده است. هر آنچه از حقوق جنگ و حقوق بشردوستانه و حقوق بشر گفته می¬شود، در این جنگ دفن شد و گورستانی از معاهدات بین¬المللی ایجاد شد. تعهدات مندرج در کنوانسیون¬های چهارگانه¬ی ژنو، کنوانسیون حمایت از حقوق کودک، اعلامیه¬ی جهانی حقوق بشر، قواعد آمره¬ی منع توسل به زور و بسیاری دیگر از اسناد بین¬المللی که عمدتا در قالب عرف بین¬المللی برای تمامی تابعان در حقوق بین¬الملل لازم الاتباع هستند، در حملات اکتبر 2023 اسرائیل به غزه نادیده گرفته شد و مدعیان نیز نظاره¬گر این نقض¬های آشکار بودند. به نظر می¬رسد که حقوق بین¬الملل کماکان از ضعف مبنایی خود که همان خلاء ضمانت اجرایی مناسب است رنج می¬برد. صاحبان حق وتو، هیچ¬گاه نمی¬توانند اراده¬ی جهانی را محقق سازند و رنج-های بی¬شمار بشری را بکاهند. گرچه در مرحله¬ی تقنین، قواعد متناسب با حقوق بشری تدوین شده است ولی این مقررات بدون وجود مرجعی الزام¬کننده، قادر به خلق زمینه¬های اجرائی نیست. /downloadfilepdf/1393196
