Also, due to the increase in the number of families in favor of taking care of pets such as dogs, cats, all kinds of birds, etc., laws and regulations regarding the protection of animals and maintaining their basic rights have been established in many developed countries. The first challenge ahead is the power of the legal regulations protecting the wild and domestic animals, with the explanation that some laws have strong enforcement power in the respective countries, but in others, they have weak enforcement power. The second challenge is the weakness of the supervisory system of relevant organizations and some developed countries. The third challenge is the pressure of laws on pet owners. The present article, with the descriptive-analytical method and with the aim of developing legal literature with a "supportive and protective" approach, seeks to evaluate these issues and seeks to prove that "supportive and protective" legislative policy approach is subordinate to "rights" rather than "rights" being used as a tool to justify human cruel actions against animals. در گذشته، هیچ قانونی برای جلوگیری از شکار بی‌رویه حیوانات وجود نداشت و همین امر سبب انقراض نسل بسیاری از گونه‌های نادر شد. بعد از این جریانات، قوانین متعددی برای پیشگیری از انقراض نسل باقی گونه‌های موجود وضع شد. همچنین، با توجه به افزایش شمار خانواده‌های طرفدار سرپرستی حیوانات خانگی از قبیل سگ، گربه، انواع پرندگان و غیره، قوانین و مقرراتی در رابطه با حمایت از حیوانات و حفظ حقوق اولیه آن‌ها در بسیاری از کشورهای پیشرفته وضع گردید. بر این اساس، اولین چالش پیش‌ رو، قدرت قوانین حقوقی حمایت از حیوانات وحشی و اهلی دولت‌هاست؛ با این توضیح که برخی از قوانین دارای قدرت اجرایی قوی در کشورهای مربوطه بوده ولی در برخی دیگر دارای قدرت اجرایی ضعیف هستند. دومین چالش، ضعف سیستم نظارتی سازمان‌های ذی‌ربط و برخی کشورهای توسعه‌یافته و سومین چالش، اعمال فشار قوانین بر صاحبان حیوانات خانگی است. مقاله حاضر با روش توصیفی-تحلیلی و با هدف توسعه ادبیات حقوقی با رویکرد «حمایتی و حفاظتی» به دنبال ارزیابی این مسائل و اثبات رویکرد سیاست تقنینی «حمایتی و حفاظتی» تابع «حقوق» است، نه اینکه «حقوق» به‌مثابه ابزاری برای توجیه اقدامات ظالمانه انسانی علیه حیوانات باشد. /downloadfilepdf/1748848
