One of the fields of application of artificial intelligence is in the judicial system, which is able to create improvements and gaps in the judicial process. In this research, by using library tools and descriptive-analytical methods, a better understanding of the impact of artificial intelligence on the justice system was discussed and we came to the conclusion that by using artificial intelligence, significant improvements can be made in efficiency, accuracy, speed and access to justice. in the judicial system. Also, while expressing the shortcomings of this technology in the field of judgment, we realized the fact that artificial intelligence, with its current capabilities, is not a suitable substitute for the position of judge and can only serve as a tool for judges and help them in handling and resolving issues. help to resolve disputes more quickly and accurately. Due to the fact that Iran's law regarding the conditions of the judge is affected by jurisprudence and is behind other legal systems in applying artificial intelligence in its proceedings, therefore it faces challenges in this field. چکیده امروزه هوش مصنوعی با اثبات قابلیت‌ها و کارآمدی خود جریان انقلاب چهارم را به راه انداخته و همچون موجی عظیم و قدرتمند همه عرصه‌های زندگی انسان را در برگرفته و به یاری بسیاری از مشاغل برخاسته است. یکی از حوزه‌های کاربرد هوش مصنوعی در نظام دادرسی می‌باشد که قادر است بهبودها و خلأ‌هایی را در فرایند رسیدگی قضایی ایجاد نماید. در این پژوهش با استفاده از ابزار کتابخانه‌ای و روش توصیفی- تحلیلی به شناخت بهتر از تاثیر هوش مصنوعی بر نظام دادرسی پرداخته شده و بدین نتیجه دست یافتیم که با استفاده از هوش مصنوعی می‌توان بهبودهای قابل توجهی در کارایی، دقت، سرعت و دسترسی به عدالت در سیستم قضایی داشت. همچنین ضمن بیان کمبودهای این فناوری در عرصه قضاوت، به این واقعیت پی بردیم که هوش مصنوعی، با قابلیت‌های فعلی‌ای که دارد جایگزین مناسبی برای منصب قضاوت نمی‌باشد و فقط می‌تواند به عنوان وسیله‌ای در خدمت قضات در بیاید و به آنان در رسیدگی و حل و فصل سریع‌تر و دقیق‌تر اختلافات کمک نماید. با توجه به اینکه حقوق ایران در خصوص شرایط قاضی متاثر از قواعد فقهی می‌باشد و نسبت به دیگر نظام های حقوقی در به کارگیری هوش مصنوعی در رسیدگی‌های خود عقب‌تر می‌باشد، لذا با چالش‌هایی در این زمینه مواجه می‌باشد. /downloadfilepdf/1937462
