Despite the enactment of the Political Crimes Law in 2016, significant shortcomings and inadequacies are still observed in the areas of identifying instances, the trial process, determining punishment, and protecting the rights of the accused, which has challenged the realization of criminal justice in this field. The findings of the article show that the effective realization of a differentiated criminal policy requires a serious review of substantive and formal laws, clarification of the political and security boundary, strengthening the role of the jury, and ensuring that political defendants enjoy special and exclusive rights. Finally, solutions based on limiting the scope of political crimes, increasing the transparency of the investigation process, strengthening the position of the jury, and practical distinction in punishment and trial have been proposed for the development of differential criminal policy, so that differential criminal policy can be implemented efficiently in the Iranian criminal system. پژوهش حاضر با رویکردی تحلیلی-انتقادی به بررسی ضرورت و ابعاد توسعه «افتراق» میان جرائم سیاسی و سایر جرائم در ایران می‌پردازد. باوجود تصویب قانون جرم سیاسی در سال 1395، همچنان کاستی‌ها و نارسایی‌های قابل‌توجهی در حوزه شناسایی مصادیق، فرآیند دادرسی، تعیین مجازات و حمایت از حقوق متهمان مشاهده می‌شود که تحقق عدالت کیفری در این زمینه را با چالش روبه‌رو کرده است. یافته‌های مقاله نشان می‌دهد که تحقق مؤثر سیاست کیفری افتراقی نیازمند بازنگری جدی در قوانین ماهوی و شکلی، شفاف‌سازی مرز سیاسی و امنیتی و تقویت نقش هیئت‌منصفه و تضمین برخورداری متهمان سیاسی از حقوق ویژه و اختصاصی است. در پایان راهکارهایی مبتنی بر تحدید قلمروی جرائم سیاسی، افزایش شفافیت فرآیند رسیدگی، تقویت جایگاه هیئت‌منصفه و تمایز عملی در مجازات و دادرسی را برای توسعه سیاست کیفری افتراقی، پیشنهاد شده است تا سیاست کیفری افتراقی به شکل کارآمد در نظام کیفری ایران اجرا گردد. /downloadfilepdf/2158683
