This study aimed to examine the feasibility of concluding a marriage contract with artificial intelligence in the jurisprudential and legal system of Iran and certain international systems. The research method was descriptive–analytical and based on library resources. The author analyzed legal and jurisprudential documents in Iran and conducted a comparative study of selected legal systems, including the European Union, Japan, Saudi Arabia, and the United States, to investigate legal, jurisprudential, and ethical challenges. The findings indicated that, due to the lack of legal personality and capacity in artificial intelligence, it could not assume legal responsibility, possess valid intent for offer and acceptance, engage in procreation, or participate in family formation. The results also revealed that even in international legal systems, marriage with artificial intelligence has not been recognized. Therefore, under current conditions, concluding a marriage contract with artificial intelligence is legally, jurisprudentially, and internationally invalid, and there is a need for serious reconsideration of the fundamental concepts of private law in the face of emerging technologies هوش مصنوعی به‌عنوان پدیده‌ای نوظهور در دهه‌های اخیر، پرسش‌های بنیادینی در حوزه حقوق، به‌ویژه در قراردادهای شخصی مانند عقد نکاح، به وجود آورده بود. پژوهش حاضر با هدف بررسی امکان‌پذیری انعقاد عقد نکاح با هوش مصنوعی در نظام فقهی و حقوقی ایران و برخی نظام‌های بین‌المللی انجام گرفت. روش تحقیق در این پژوهش، توصیفی‌-تحلیلی و مبتنی بر منابع کتابخانه‌ای بوده است. نگارنده با تحلیل اسناد قانونی و فقهی در ایران، و بررسی نظام‌های حقوقی منتخب از جمله اتحادیه اروپا، ژاپن ، عربستان سعودی و آمریکا چالش‌های حقوقی، فقهی و اخلاقی این موضوع را مورد بررسی قرار داد. یافته‌ها نشان دادند که با توجه به فقدان شخصیت و اهلیت در هوش مصنوعی، امکان پذیرش مسئولیت حقوقی، اراده معتبر برای ایجاب و قبول، ایفای نقش در تولید مثل و مشارکت در تشکیل خانواده برای این سامانه‌ها وجود نداشت. همچنین بررسی‌ها نشان دادند که حتی در نظام‌های حقوقی بین المللی نیز نکاح با هوش مصنوعی به رسمیت شناخته نشده است. بر این اساس، در شرایط کنونی، انعقاد عقد نکاح با هوش مصنوعی از منظر حقوقی ، فقهی و بین المللی نامعتبر بوده و نیاز به بازنگری جدی در مفاهیم بنیادین حقوقی در مواجهه با فناوری‌های نوین احساس می‌شد. /downloadfilepdf/2228752
