In this regard, almost all countries have sought to standardize these sounds and, by enacting general and specific laws in this area, have attempted to cover this type of pollution to take an effective step towards realizing acoustic justice and promoting the psychological peace of individuals within society. However, the existing laws and executive regulations in this field face shortcomings in some cases regarding the full coverage of this problem; shortcomings that, on the one hand, require reflection and, on the other hand, necessitate reform and improvement to an optimal level. The present study, using a descriptive-analytical method and relying on library resources and documents, examines the legislative evolution of these issues and its pathology. The research findings indicate that specific laws related to noise pollution and relevant executive regulations, in order to move towards the realization of acoustic justice, require the redefinition of certain concepts, the utilization of cultural capacities, attention to social custom, and the consideration of economic factors as effective tools. Such an approach can, on the one hand, prevent the violation of the rights of vulnerable citizens, and on the other hand, pave the way for the practical realization of the right to a healthy environment. چکیده یکی از شقوق «حق بر محیط‌زیست سالم» به‌عنوان یکی از حقوق مهم و بنیادین بشر، تأمین امنیت جسمی و روانی انسان در برابر هرگونه اصوات ناهنجار و غیراستاندارد محیطی است. در این راستا، قریب به اتفاق کشورها در صدد استانداردسازی این اصوات برآمده و با وضع قوانین عادی و خاص در این حوزه، تلاش کرده‌اند این نوع از آلودگی‌ها را تحت پوشش قرار دهند تا گامی مؤثر در جهت تحقق عدالت آکوستیک و ارتقای آرامش روانی افراد در بستر جامعه بردارند. با این حال، قوانین و آیین‌نامه‌های اجرایی موجود در این حوزه در برخی موارد با کاستی‌هایی در پوشش کامل این معضل مواجه‌اند؛ کاستی‌هایی که از یک سو نیازمند تأمل و از سوی دیگر مستلزم اصلاح و ارتقا به سطح مطلوب می‌باشند. پژوهش حاضر با روش توصیفی ـ تحلیلی و با استفاده از منابع و اسناد کتابخانه‌ای، به بررسی سیر تقنینی این مباحث و آسیب‌شناسی آن پرداخته است. یافته‌های پژوهش نشان می‌دهد که قوانین خاص مربوط به آلودگی صوتی و آیین‌نامه‌های اجرایی مرتبط، برای حرکت به سوی تحقق عدالت آکوستیک نیازمند بازتعریف برخی مفاهیم و بهره‌گیری از ظرفیت‌های فرهنگی، توجه به عرف اجتماعی و در نظر گرفتن عوامل اقتصادی به‌عنوان ابزارهای مؤثر هستند. چنین رویکردی می‌تواند از یک سو از تضییع حقوق شهروندان آسیب‌پذیر جلوگیری کند و از سوی دیگر، زمینه تحقق عملی حق بر محیط‌زیست سالم را فراهم آورد. /downloadfilepdf/2452927
