This study seeks to elucidate key concepts such as data ownership, rights arising from data possession, and the position of blockchain-based assets within civil and specialized legal systems. Employing an analytical-comparative approach, this research examines and evaluates the existing legal literature concerning digital rights, information ownership, and digital assets. The methodology includes an in-depth study of scientific articles, journals, and research related to novel data governance frameworks, digital ownership, and the legal implications of managing digital assets. Key findings indicate that the digital economy has introduced unprecedented challenges to traditional legal systems. Concepts such as data ownership and digital assets require more precise definition and regulation. Furthermore, data governance frameworks and property rights in the digital space are evolving, making their adaptation to technological advancements essential. Liability arising from data possession and the legal consequences of information capitalization are among other significant issues identified. The conclusion is that the legal system is facing the rapid transformations of the digital economy and the emergence of digital assets, necessitating a revision and development of its legal frameworks to address these challenges. Effective data regulation and the establishment of clear rights in the domain of digital ownership will be a fundamental step towards ensuring legal certainty and facilitating the sustainable growth of the digital economy. هدف اصلی این بررسی، تحلیل جامع و چندوجهی چارچوب‌های حقوقی و چالش‌های مرتبط با دارایی‌ها و اطلاعات دیجیتال در عصر اقتصاد دیجیتال است. این مطالعه به دنبال روشن ساختن مفاهیم کلیدی مانند مالکیت داده، حقوق ناشی از تصرف داده، و جایگاه دارایی‌های مبتنی بر بلاکچین در نظام‌های حقوقی مدنی و تخصصی است. این تحقیق با اتخاذ رویکردی تحلیلی-تطبیقی، به بررسی و ارزیابی ادبیات حقوقی موجود در زمینه حقوق دیجیتال، مالکیت اطلاعات، و دارایی‌های دیجیتال پرداخته است. روش‌شناسی شامل مطالعه عمیق مقالات علمی، فصلنامه‌ها و پژوهش‌های مرتبط با چارچوب‌های نوین حاکمیت داده، مالکیت دیجیتال، و پیامدهای حقوقی مدیریت دارایی‌های دیجیتال است. یافته‌های کلیدی نشان می‌دهند که اقتصاد دیجیتال چالش‌های نوینی را برای نظام‌های حقوقی سنتی ایجاد کرده است. مفاهیمی چون مالکیت داده و دارایی‌های دیجیتال نیازمند تعریف و تنظیم‌گری دقیق‌تری هستند. همچنین، چارچوب‌های حاکمیت داده و حقوق مالکیت در فضای دیجیتال در حال تحول بوده و تطبیق آن‌ها با پیشرفت‌های فناوری امری ضروری است. مسئولیت ناشی از تصرف داده و پیامدهای حقوقی سرمایه‌سازی اطلاعات از دیگر مباحث مهم یافت شده است. نتیجه‌گیری این است که نظام حقوقی با تحولات سریع اقتصاد دیجیتال و ظهور دارایی‌های دیجیتال مواجه است و نیازمند بازنگری و توسعه چارچوب‌های قانونی خود برای پاسخگویی به این چالش‌ها می‌باشد. تنظیم‌گری مؤثر داده‌ها و تعیین حقوق روشن در حوزه مالکیت دیجیتال، گامی اساسی در جهت ایجاد اطمینان حقوقی و تسهیل رشد پایدار اقتصاد دیجیتال خواهد بود. /downloadfilepdf/2535346
