In the field of international trade law, the transfer of goods and the speed of trade are fundamental factors in the dynamics and production of wealth and turnover. In this regard, transportation is an operational tool of international trade that is done by air, rail, road and sea. The subject of this article is the international transport of goods by road, which is done in accordance with the CMR Convention. An attempt has been made to answer the question of what is the meaning, definition and features of the bill of loading and guidelines in international road transport in domestic law and uniform international document with a comparative view and library and analytical method. In order to unify the domestic and global legal system, we should also get acquainted with the legal regime of the said convention. Finally, we come to the conclusion that there are substantial differences between the Consignment note and the bill of loading. The bill of loading is a commercial document, but it is not a document of ownership and transfer, it can not be collateralized. Both the bill of loading and the Consignment note are the reason for the existence of a transport contract and the receipt of the goods by the Carrier. قراردادهای حمل ونقل در حقوق تجارت بین‏الملل و حقوق داخلی وجوه گوناگونی دارد. در پهنه ی حقوق تجارت بین‏الملل، انتقال کالا و سرعت در عملیات تجاری، عوامل اساسی تولید ثروت و گردش مالی می‏باشند. در این راستا، حمل ونقل، وسیله عمده ی تجارت بین‏الملل است که به شیوه‏های هوایی، ریلی، جاده‏ای و دریایی صورت می‏گیرد. موضوع این نوشتار، حمل ونقل بین‏المللی کالا از طریق جاده می‏باشد که بر اساس کنوانسیون CMR انجام می‏گیرد. در این مقاله تلاش شده با نگاه تطبیقی و شیوه ی کتابخانه‏ای و تحلیلی، به این پرسش پاسخ داده شود که بارنامه و راه نامه در حمل ونقل بین‏المللی جاده‏ای در حقوق داخلی و سند یکنواخت بین‏المللی چه مفهوم، تعریف و ویژگی‏ دارد تا ضمن پاسخ به نیاز حقوقی جاده‏ای داخلی، در راستای متحدالشکل کردن نظام حقوقی داخلی و خارجی با رژیم حقوقی کنوانسیون یادشده مطلع گردید. در نهایت به این نتیجه می‏رسیم که در دیدگاه هم‏سنجی میان راه نامه و بارنامه تفاوت‏های ماهوی وجود دارد. راه نامه، یک سند تجاری است اما سند مالکیت و انتقال نبوده، قابلیت توثیق و رهانت ندارد. هردو سند بارنامه و راه نامه، دلیل وجود یک قرارداد حمل ونقل و مبنی بر دریافت کالا به وسیله متصدی ترابری است. /downloadfilepdf/36465
