Because the enormous impact of the family institution as the foundation of the human society is obvious and undeniable. In this regard, it can be clearly stated that the strength of the family foundation is based on the role of a woman as a wife and the high position of a mother. The clarity of this statement considering the duties that women perform in the family is ascertained. Considering that men and women are inherently different from each other in terms of physical and mental dimensions, the Holy Sharia has made these differences the criteria for determining the punishment in crimes subject to limits, retribution and diat. The legislator of the Islamic Republic has also allowed to adhere to principles such as the principle of individualization in order to determine the punishment in order to achieve the goals and purposes of the punishment. In the issue of proportionality of women's punishment, we have addressed the issue that in the event of a crime committed by women, taking into consideration the differences in creation and the vulnerability of this group and the interest of the family and its protection, appropriate punishment should be considered. The importance of this issue is because a woman has two important duties as a mother and a wife in the family, and not paying attention to this issue is a serious threat to the health of the future generation of mothers and their children. This research seeks to look at the legislator's performance in imposing punishment on women using critical analytical library methods. After examining the materials such as: the foundations, criteria and effects of punishment for women, it is revealed that in spite of the essential role of women in the field of the family and despite the emphasis and jurisprudential and legal documents on the need to strengthen the foundation of the family, in the field of crimes subject to punishment, there is no provision for determining the punishment of female offenders based on the principle of the supreme interest of the family, and there is a legal gap in this field. امروزه مسئله حفظ تحکیم بنیان خانواده و تلاش در جهت صیانت از آن بر مبنای اصل مصلحت، یکی از مهم ترین و ضروری ترین مسائل اجتماعی و فرهنگی محسوب می گردد. زیرا که تاثیر به سزای نهاد خانواده به عنوان زیر بنای ساختار جامعه بشری در مقابل جامعه پیش رو، بدیهی و انکار ناپذیر است. در این راستا می توان به صراحت بیان نمود که، استحکام بنیان خانواده بر مبنای نقش زن در مقام همسر و مقام والای مادری استوار است. صراحت این سخن با عنایت به وظایفی که زن در خانواده ایفا می کند، محرز می گردد. نظر به آن که زن و مرد ذاتاً و خلقتاً به لحاظ جسمی و ابعاد روحی متفاوت از یکدیگر می باشند، شارع مقدس جهت تعیین مجازات در جرایم مستوجب حدود، قصاص و دیات این تفاوت ها را ملاک قرار داده است. قانون گذار جمهوری اسلامی نیز در راستای تعیین مجازات جهت نیل به اهداف و مقاصد مجازات، تمسک به اصولی همچون اصل فردی کردن را روا داشته است. در مسئله تناسب کیفر زنان، به این موضوع پرداخته شده است که در صورت وقوع بزه کاری از ناحیه زنان با در نظر داشتن تفاوت های خلقتی و در معرض آسیب بودن این قشر و مصلحت خانواده و صیانت از آن، مجازات متناسب در نظر گرفته شود. اهمیت این موضوع از آن جهت است که زن در حوزه خانواده دو وظیفه مهم مادری و همسری را بر عهده دارد و عدم توجه به این مسئله تهدیدی جدی نسبت به سلامت نسل آینده از مادران و فرزندهایشان می باشد. این تحقیق در صدد دستیابی به عملکرد قانون گذار در اعمال مجازات زنان با توجه به شاخصه عدم آسیب خانواده و فرزندان، به صورت تحلیلی-انتقادی و کتابخانه ای می باشد. پس از بررسی مطالب از جمله مبانی، معیارها و جلوهای تناسب کیفر زنان، مشخص شده است که با توجه به نقش اساسی زن در حوزه خانواده و علی رغم تاکیدات و مستندات فقهی-حقوقی بر ضرورت تحکیم بنیان خانواده، در حوزه جرایم مستوجب تعزیر، شاخصه ای جهت تعیین مجازات زنان بزه کار بر مبنای اصل مصلحت عالیه خانواده پیش بینی نشده است و در این زمینه خلاء قانونی وجود دارد. /downloadfilepdf/414530
