One of the most important related fields of international law in this field is the law of the seas. The law of the seas has a history as old as being at sea, however, little attention has been paid to the ability to apply and enforce human rights rules at sea. Yet, important documents on the law of the sea, including the Convention on the Law of the Sea, have paid attention to the application of human rights rules at sea. Many commentators have argued that some of the provisions of the Convention on the Law of the Sea embody human rights principles that have not been effectively used to their full potential to date. Although the identification and implementation of human rights rules in the light of the principles and rules of the law of the sea is somewhat difficult and complicated, nevertheless, the Convention on the Law of the Sea has also approved human rights rules in some of its provisions. It is an important issue whether people at sea have human rights and whether governments are obliged to protect these rights and ensure that people enjoy these rights. This article discusses the human rights considerations in the Convention on the Law of the Sea and the judicial procedure of the International Court of Law of the Sea in this field. حضور کشتی ها و انسان ها در دریاها، مسئله ی رعایت اصول و قواعد حقوق بشری از سوی کشورهای ساحلی و صاحب بندر، به خصوص در زمان توقیف کشتی ها و یا در خطر بودن افراد در دریا را مطرح می کند. یکی از مهم ترین حوزه های مرتبط حقوق بین الملل در این زمینه حقوق دریاها است. حقوق دریاها به قدمت حضور در دریا تاریخچه دارد، با این وجود توجه کمی به قابلیت اعمال و اجرای قواعد حقوق بشری در دریا شده است. با این حال اسناد مهم حقوق دریاها از جمله کنوانسیون حقوق دریاها به اعمال قواعد حقوق بشری در دریا توجه داشته اند. بسیاری از مفسران استدلال کرده اند که برخی از مقررات کنوانسیون حقوق دریاها متضمن اصول حقوق بشری است که تا به امروز به طور موثری از ظرفیت های موجود در آن استفاده نشده است. اگرچه شناسایی و اجرای قواعد حقوق بشری در پرتو اصول و قواعد حقوق دریاها تا حدی سخت و پیچیده است، با این حال کنوانسیون حقوق دریاها در برخی مقررات خود به تایید قواعد حقوق بشری نیز پرداخته است. این مساله مهم است که آیا افراد حاضر در دریا از حقوق بشر برخوردارند و این که آیا دولت ها موظف به حمایت از این حقوق و تضمین برخورداری افراد از این حقوق هستند. در این نوشتار به ملاحظات حقوق بشری در کنوانسیون حقوق دریاها و رویه قضایی دیوان بین المللی حقوق دریاها در این زمینه پرداخته خواهد شد. /downloadfilepdf/514908
