Recognizing these differences and agreements has prevented gross errors of public and private rights in the future between these religious communities, or is of great help in promoting common laws between them. Therefore, the purpose of this study was to examine the right of usufruct in the financial and economic laws of Iran by comparing the rulings of the Jewish religion. In this study, the types of usufruct rights in Islam and Iranian law were investigated, because the usufruct rights were not defined in the Jewish religion as in the Islamic religion, concepts related to charity, social justice, endowment, charity and tzedakah were used to investigate the nature of usufruct. became. The study method was descriptive, analytical and library method. The findings show a clear definition of usufruct and its types and conditions in Islam, and in the Jewish religion there are concepts such as tzedakah, from which the word charity in Arabic can be taken, as a general concept related to usufruct. or social justice has been raised and each of the different types of tzedakah has rituals, conditions and people to be able to implement tzedakah in the best way in the Jewish society. تناسب و تضادهای فرهنگی ریشه در باورهای دینی و آیین‌‌های مذهبی داشته و شناسایی تعارض‌‌‌ها و توافقات دینی نقش موثری بر تعامل بین جوامع دینی ایفا می‌کنند. شناخت این تعارض‌‌‌ها و مشترکات از بروز خطاهای عمده در حقوق عمومی و خصوصی جلوگیری کرده و فی مابین این جوامع دینی رشد به عمل آورده و در ارتقای قوانین مشترک بین آن‌ها کمک می نماید. بنابراین ، هدف این مقاله بررسی حق انتفاع در حقوق مالی و اقتصادی قوانین ایران با تطبیق احکام دین یهود است. این مطالعه به بررسی اقسام حق انتفاع در دین اسلام و حقوق ایران می پردازد.ازآنجا که حق انتفاع در دین یهود به مانند دین اسلام تعریف نشده ، از مفاهیمی مرتبط با عدالت اجتماعی، چون خیریه ، وقف، صدقه و تزداکه برای بررسی ماهیت انتفاع استفاده گردید. مقاله به شیوه توصیفی تحلیلی و سبک کتابخانه ای است. یافته‌‌‌ها نشان می دهد که تعریف مشخص از حق انتفاع و اقسام و شرایط آن در دین اسلام وجود داشته و در دین یهود مفاهیمی چون وقف ، انفاق وتزداکه( صدقه) را می توان نام برد، این مفهوم کلی مرتبط با حق انتفاع یا عدالت اجتماعی مطرح است و هر یک از انواع مختلف این آیین ها ، شرایطی دارند تا بتوانند به بهترین صورت ممکنه آن را در جامعه یهودیان پیاده کنند. /downloadfilepdf/62222
