And reconciliation between the power of the government and the rights and freedoms of the people, and in this regard have carried out numerous supervisory duties In order to protect the rights and freedoms of individuals for government forces have been specified and emphasized. In the Islamic Republic of Iran, as a democratic system, fundamental rights and freedoms, as an area accepted by reason and sharia, are at the top of social expectations, and in this regard, in addition to criminalization, various government guarantees in various manifestations to protect rights. And legal action in case of violation is provided; In the same direction and with Considering the central importance of freedom and the repeated provisions of the Constitution of the Islamic Republic of Iran on the need to protect rights and freedoms, while considering the original role of the judiciary in protecting rights and freedoms, while discussing freedom and the general concept Supervision, evaluation of the oversight duties of the Judiciary of the Islamic Republic of Iran in relation to rights and freedoms are considered by the author. به گواه تجربه ی تاریخی بشر، نتیجه¬ی تقابل قدرت و آزادی، استیلای قدرت حکومتی و تضییق حقوق و آزادی افراد بوده است؛ بنابراین قوانین اساسی به ویژه قوانین اساسی کشورهای متمدن در جهت حمایت از حیثیت و منزلت انسانی با این منطق که قدرت را باید تنظیم و حقوق و آزادی ها را تضمین نمود ابتدا در مقام بیان، احیای و تضمین آزادی ها و سپس در مقام تلفیق و آشتی بین قدرت حکومت و حقوق و آزادی های مردم بوده اند و در همین راستا وظایف نظارتی متعددی را در جهت صیانت از حقوق و آزادی های افراد برای قوای حکومتی مورد تصریح و تأکید قرار داده‏اند. در جمهوری اسلامی ایران نیز به عنوان یک نظام مردم سالار، حقوق و آزادی های اساسی به عنوان حیطه ی مورد پذیرش عقل و شرع، در رأس توقعات اجتماعی قرار گرفته و در همین راستا علاوه بر جرم انگاری، تضمین حکومتی مختلف در جلوه های گوناگون به منظور حفظ حقوق مزبور و پیگیری قانونی در صورت نقض آن ها، پیش بینی شده است؛ در همین راستا و با در نظر گرفتن اهمیت کانونی آزادی و تصریح مکرر قانون گذار اساسی و عادی جمهوری اسلامی ایران به ضرورت صیانت از حقوق و آزادی ها و با امعان نظر به نقش اصیل قوه¬ی قضائیه در صیانت از حقوق و آزادی‏ها، ضمن بحث پیرامون آزادی و مفهوم کلی نظارت، ارزیابی وظایف نظارتی قوه¬ی قضائیه جمهوری اسلامی ایران در رابطه با حقوق و آزادی¬ها مطمح نظر نگارنده قرار می‏گیرد. /downloadfilepdf/71016
