This issue is rooted in old traditions or jurisprudence-religion that has infiltrated the laws of countries. In Iran, although there is a discussion of legal murder in local cultures, the main source of Iran's Islamic Penal Code is jurisprudence, and the conditions considered in this law for authorized murders originate from jurisprudence. In the United States, this issue is mostly derived from the common law system, but the local culture has also influenced this issue, and therefore we see that in some states, different conditions are considered in regrd with authorized murder than in other states. Considering this issue, we have done an analytical-descriptive study of the issue of authorized murder in the criminal systems of Iran and America and we have advanced our discussion with the library method. The results of the research show that legal murder in Iran has strict conditions that make it very difficult to strictly comply with the legal standards for committing murder at that moment and this causes the legislator to not recognize authorized murder but instead authorized murder. In contrast, in America, especially in the state of Texas, it has the conditions that the legislator has considered certain signs for committing murder and this issue has caused many murders to be committed and thus, the lax conditions of the legislator have caused the spread of this type of murder. قتل مجاز، موضوع پیچیده‌ای بوده که قانون‌گذار، ارتکاب آن را با اعمال استثنائاتی مجاز دانسته و شرایطی را در قانون برای آن به وجود آورده است. این موضوع، ریشه در سنت‌های قدیمی و فقهی-دینی دارد که به قوانین کشورها رخنه کرده است. در ایران نیز گرچه بحث قتل مجاز در فرهنگ‌های محلی وجود دارد ولی منشأ اصلی قانون مجازات اسلامی ایران، فقه بوده و شرایطی که در این قانون برای قتل‌های مجاز در نظر گرفته‌ شده، منبعث از فقه است. در ایالات‌متحده نیز این موضوع بیشتر از نظام کامن‌‌لا منشأ گرفته ولی فرهنگ محلی نیز بر آن تأثیر گذاشته است. لذا، شاهد این موضوع هستیم که پیرامون موضوع قتل مجاز، در برخی ایالت‌ها شرایط متفاوتی نسبت به دیگر ایالت‌ها در نظر گرفته ‌شده است. با لحاظ این موضوع به بررسی تحلیلی-توصیفی موضوع قتل مجاز در نظام‌های کیفری ایران و آمریکا پرداخته و با روش کتابخانه‌ای بحث خود را پیش می‌‌بریم. نتایج تحقیق نشان می‌دهد که قتل مجاز در ایران دارای شرایط سخت‌گیرانه‌ای بوده که رعایت دقیق موازین قانونی را برای ارتکاب قتل در آن لحظه بسیار دشوار می‌سازد. این موضوع باعث عدم شناسایی قتل مجاز توسط قانون‌گذار می‌شود. در مقابل، قتل مجاز در آمریکا، به‌خصوص در ایالت تگزاس، دارای شرایطی بوده که قانون‌گذار، نشانه‌های مشخصی را برای ارتکاب قتل مجاز در نظر گرفته است. این موضوع باعث انجام قتل‏های بسیاری شده که علت رواج آن، شرایط سهل قانون‌گذار است. /downloadfilepdf/957959
